Hallo!
Ich muss zwei Sparbücher aus der Hinterlegung herausgeben deren Guthaben sich insgesamt auf ca. 5550,00 Euro beläuft.
Wie berechne ich die Kosten?
Bisher habe ich nur gefunden, dass ich zwischen 8,00 Euro und 255,00 Euro anfordern kann.
Aber wie wird gestaffelt?
Hat jemand einen Tip?
Nach freiem Ermessen, denke ich.
Ich hatte bisher nur einen Fall, der keine Geldhinterlegung war und in dem ich daher Kosten zu nehmen hatte. Da dieses Verfahren damals recht viel Arbeit gemacht hatte und sich lange hinzog, habe ich eine Gebühr am oberen Ende des Rahmens genommen. Allerdings ging es dabei auch um Grundpfandbriefe über mehrere 100.000 €.

Da das eine reine Ermessensentscheidung ist:
Wir haben ca 10% des Betrages erhoben, natürlich Mindest- und Höchstgeb. beachtet.
Inzwischen werden hier die Gebühren von der Serviceeinheit berechnet.
Ich würde auch Schwierigkeit und Länge des Verfahrens mit einfließen lassen.
2007 wurde hier ein Sparbuch zur Hinterlegung angenommen. Hinterlegt wurde es von der ehem. Betreuerin einer Dame, die sich nach Aufhebung der Betreuung geweigert hat, das Sparbuch anzunehmen.
Die Dame ist nun verstorben. Unter Vorlage der Erbscheinsausfertigung beantragt nun der Sohn und Alleinerbe die Herausgabe. Soweit kein Problem, aber:
Welche Kosten muss ich berechnen?
Gilt § 33 Abs. 1 HintG NRW (der ja erst ab 01.01.2011 anzuwenden ist) hier schon? Mit Verweis auf das Justizgesetz NRW und dort Verweis auf die JVKostO?
Wer ist Kostenschuldner, der Empfänger des Sparbuchs?
Macht ihr die Herausgabe von der Zahlung der Kosten abhängig?
Wird die OJK Hamm des Sparbuch per Einschreiben gegen Rückschein übersenden? Muss ich diese Auslagen dann nach § 35 HintG NRW der Kostenrechnung hinzusetzen?
Welche Gebühr würdet ihr ansetzen? Bei ca. 1.000 € Sparubchguthaben nach der oben geposteten Tabelle eine Gebühr von 13,00 €?

Vielen Dank @ AKoehler!!! Ich fand 13 € nach der hier eingestellten Tabelle auch etwas wenig, grad in Anbetracht der Tatsache, dass ich mich mit der Sache Stunden lang beschäftigen musste... haha. 
Ich hab auf jeden Fall die von Dir vorgeschlagenen 30 € genommen.
